Can I claim if the driver didn’t stop?
If you don’t know who was responsible for knocking you off your bike, you can start a claim against the Motor Insurers’ Bureau (MIB). Our solicitors regularly handle MIB claims where motorists left the scene of a road traffic accident or where the motorist was uninsured.
Can I claim if the motorist wasn’t prosecuted?
If you are knocked off your motorcycle you should call the police and report the accident, even if you don’t initially think that your injuries are serious.
Whilst you may be disappointed if the motorist who knocked you off your bike isn’t prosecuted, it doesn’t stop you from bringing a civil claim against the motorist and their insurer or against the MIB if the motorist didn’t have insurance.

Can I claim if there are no witnesses?
You can still start a claim even if there are no witnesses to you being knocked off your motorcycle.
Sometimes witnesses come forward later after an appeal is made, but it always helps to take pictures of where you and your bike ended up, the other vehicle, scuff and skid marks, and the general scenery.
