Mr A was on his way to work and filled his bike up at a petrol station. As he left the garage, he approached a roundabout and lost control of his bike due to the presence of oil or diesel on the road – his bike slipped from under him and landed directly on his leg and ankle.
Mr A was taken to hospital where it was determined that he had sustained a complex fracture of his ankle. He underwent reconstruction of the ankle joint (including the insertion of pins and plates) and remained as an inpatient four weeks.
Bikelawyer initiated a claim under the Motor Insurers’ Bureau’s (MIB) Untraced Drivers’ Agreement. The medical expert in the case determined that Mr A would go on to get arthritis in his ankle and would need ankle fusion surgery or a full ankle replacement within five years.
