Motorcycle accident liability

Once they receive our letter of claim, the other side have to set out their position on liability. They will either concede liability in full, contest it, or admit they were partly at fault but attempt to allege that you contributed to the accident too.

It’s a sad fact that insurers often assume bikers are usually at fault and so when presented with motorcycle accident claims they generally dispute them.

If liability is disputed, or partly disputed, then we’ll need to investigate exactly how the accident happened. We’ll need to get hold of any police report, speak to witnesses and carry out any other investigations required to present your claim in the best possible light.

Rest assured, we have much experience working on accident dispute cases, and will build a robust case, helping you to achieve the best possible outcome in the circumstances.

Quantum – or “how much”

The more seriously you’re injured, the more you will receive in damages. You will get compensation for pain, suffering and loss of amenity (not being able to do things that you could before). You may also receive compensation for any financial losses which can reasonably be shown to have been caused by the accident.

Damages that might be covered include bike repairs, damaged kit, loss of earnings, care provided by family and friends etc. There are lots of things you can claim for depending on your accident and our solicitors will ensure to pursue compensation for any damages that are unique to your circumstances.

Rehabilitation

If liability is disputed, our solicitors can usually get the defendant’s insurer to pay for private rehabilitation.

However, the insurer usually only agrees to this because paying for rehabilitation from the outset, as opposed to later in the claim, is cheaper. Private rehabilitation at the outset helps prevent an injured biker’s injury turning into a permanent injury which in turn results in a larger settlement.

Regardless of the circumstances, we will support all clients to access any rehabilitation support that they require during this difficult time.

Medical evidence

In order to prove how badly you’ve been injured, we’ll have to get medical evidence.  This will involve you going to see an independent medical expert who will write a report setting out your injuries.

We will usually start with an orthopaedic surgeon, but they may ask us to send you to an expert in another discipline depending on your injuries. Because of the nature of their accidents, bikers often experience nerve injuries so a neurology expert is common.

The experts might ask for scans like MRIs or X-rays before they can give a definitive prognosis, and where they do, we recommend you follow their medical advice.

Undergoing a full medical assessment is important, as where a person’s injuries are properly documented, it is far easier to build a successful claim.

Offers

At this stage, Bikelawyer will present your claim in full to the other side, inviting  settlement negotiations. This will usually involve a few rounds of offer and counter offer and can occasionally take some time. Once all of the evidence is complete we can usually settle your case pretty quickly.

Each case is different, but we’ll advise you how to achieve the maximum possible compensation, and work towards this goal together.

Will I have to go to trial?

Probably not, although we can’t rule it out. You have to be willing to go to trial, but the reality is that the vast majority of cases settle without the need to go to court.

When presented with a well prepared, well-argued case it’s just not in the defendant insurer’s interest to incur the cost of taking a claim to trial when it would be simpler and easier to settle it.

No win no fee

At Bikelawyer, we believe that outstanding legal support should be available to everyone, regardless of their financial circumstances. If we consider you to have good prospects of making a successful claim, we are able to act on a ‘no win no fee basis meaning that you will only be required to pay anything if your claim is successful.

When you contact us, we provide a free claims evaluation to assess whether your case is suitable for ‘no win no fee funding’ and explain your options to you. To find out more information, visit our no win no fee accident claims page here.

How long can you claim compensation after a motorcycle accident?

In the majority of motorcycle accident injury claims, you will have three years from the date that the accident occurred and failure to bring a claim within this period will result in you losing your right to compensation.

There are exceptions to this rule, such as claims brought on behalf of children in which limitation does not begin to run until their 18th birthday, meaning that they may bring their own claim up until the point that they turn 21.

Regardless, it is recommended to start the claims process as soon as possible after the accident, as doing so may improve the strength of the claim.

How much compensation will I get for a motorcycle accident in the UK?

The amount of compensation that you can receive will depend on the case, for instance, how severely you have been injured, and how far the injuries have affected your physical health, mental health, your career, and life.

At Bikelawyer, we are often able to secure higher levels of compensation in comparison to other firms. To discuss the potential value of your claim today, please contact us using the details below.
