£660,000 for seriously injured biker
In June 2017 the Claimant was riding his Kawasaki ER650 motorcycle along the A272 in West Sussex. A line of traffic ahead of the Claimant slowed and he began to overtake it on the offside. The Defendant was at the front of the queue. As the Claimant was approaching the offside of the Defendant, the Defendant began to turn right without indication. The Claimant collided with the driver’s door of the Defendant’s car and sustained serious personal injuries.
The Defendant was convicted of driving with a controlled drug in his blood in excess of the specified limit. He was 9 times the legal limit for a metabolite of cocaine.
The Claimant suffered multiple serious injuries and was left with neuropathic pain. Bikelawyer instructed multiple experts to provide evidence for the case including reports in the fields of toxicology, accident reconstruction, neurology, orthopaedics, pain, psychiatry, plastic surgery, urology, care costs and employment.
Liability was hotly contested with an initial 20% offer being made by the Defendant’s solicitors. Bikelawyer eventually achieved 75% in the Claimant’s favour, shortly before a liability trial. It took nearly 6 years for the case to be capable of quantification and before a settlement was reached in the sum of £660,000.
