£1.5 million compensation for amputee biker

Bikelawyer has settled a client’s compensation claim for £1.5 million.

The Claimant was riding his Suzuki GSXR1000 motorcycle along an A road in Hampshire when a car driver pulled out from a lay by at the side of the road into his path. The biker took evasive action but unfortunately clipped the front of the car and was sent hurtling toward a road sign. The injuries sustained by the motorcyclist led to one leg being amputated and the other leg being placed in a fixator frame.

Bikelawyer secured an immediate interim payment of £20,000 and put in place a rehabilitation package for the Claimant.

Initially liability looked straightforward and fully in favour of the Claimant. The Defendant made an early offer to settle the claim in the sum of £1.5 million. Detailed investigations into the value of the claim were commenced. However, documents came to light raising liability problems for the Claimant with the only independent witness’ evidence being unhelpful to the Claimant’s claim. It was feared that the Defendant’s offer may be withdrawn and replaced with a much lower offer.

In light of the liability difficulties the offer of £1.5 million was accepted and represented an excellent settlement.

Bikelawyer’s Senior Solicitor, Andrew Campbell, who acted for the Claimant together with Solicitor Jon Edwards, commented “It is vital that seriously injured motorcycle accident victims are represented by specialists in the field who fully understand the liability issues in motorcycle accident claims. Further that the solicitors instructed are experienced in catastrophic injury claims, like the team at Bikelawyer”.

Andrew added “Clients have complete freedom of choice of solicitor, despite what insurers tell them, and I recommend expert advice is sought by injured bikers rather than allowing a referral to an insurer panel firm which may not have the genuine expertise in complex, high value injury claims like these“.
