Title: Whiplash following accident - appointed claims handler not being proactive

Date: 12 January 2011

Whilst driving at work, a car hit me from the side. It was unable to stop due to compacted ice. Anyway, the boss has been great. Nobody was injured, but now, a few days later, my back is giving me real pain issues. It keeps me awake at night. I can't stand straight etc.

The boss put me in touch with a "claims" firm. I've filled all the stuff out and two weeks later still heard nothing. I'm not expecting instant action, but I thought by now I would be treated for my back?

I just want my back sorted. It's driving me mad; lack of sleep, pain etc but I can't afford time off work with 4 kids, Christmas etc so I stuff myself with pain killers and sleep on the floor! But how long before I get treatment?

It is quite normal for whiplash symptoms to develop 24 to 48 hours after the accident. In terms of liability the other driver should have been able to stop (or he should have been driving more slowly) and as such liability should be clear cut - that is it is his fault.

It is not acceptable that you have not heard anything from your legal representative for two weeks. Early intervention by way of physiotherapy can do wonders for whiplash injuries and you should be seen as soon as possible. A law firm can arrange this at no cost to you and yours should have done so, in addition to having lodged the claim against the other driver.

You can always switch law firms (at no cost to you) and get a more pro-active one rather than the "claims management companies" that advertise on tv. You will be able to claim for your financial losses (including private medical treatment) in addition to claiming damages for your injuries. Any decent firm will act for you on a no-win, no-fee basis.
