Title:
Negligent Driver not Responding to Claim, no Insurance and Changing Solicitors
Date:
24 November 2010
I had an accident 2 months ago which was not my fault. I rode around a tight corner and hit a tractor in my lane travelling towards me (he cut a corner in a lane and was over the white lines).
I got his name, address and telephone number (I was in shock a bit at the scene, and did not get his insurance details so I don’t even know if he actually has insurance. I did take pictures of the site and the tractor). There was no discussion over fault. I'm claiming through an accident management company.
My bike is repairable, and they have sent a cheque to the bike shop to pay for the repairs.
However, when I rang the solicitors to see if it was all finished, they stated that the 3rd party had not responded to their letters so they had not even spoken to the 3rd parties Insurance company
My question is, if they cannot get a response, or if it turns out he has no insurance, would they then seek to reclaim the repair costs back from me?

Most farmers are insured through the NFU. Enquiries with them should reveal if this is the case. You have his name and address so should there be no response court proceedings can be commenced against him. Also if your photos reveal a registration number on the tractor his insurer can be found by a Motor Insurers' Database (MID) search which solicitors can carry out. Then correspondence can be directly with the insurer. You don't mention any injuries but if you were injured then you can claim for those injuries as well as financial losses. If it transpires that there is no insurance then the MIB can compensate through its uninsured drivers scheme. Finally if you get nowhere with your insurer appointed solicitors utilise your right to instruct the solicitor of your choice and switch for free. Choose a bike accident specialist.
